Read the terms and conditions governing the use of Transit & Flow’s website, services, and online communications.

Effective Date: July 2, 2026 

By accessing our website, mobile applications, or services, you agree to be bound by these Terms of Service and confirm that you are responsible for compliance with all applicable local, state, and federal laws.

THE FOLLOWING TERMS AND CONDITIONS (“TERMS”) ARE A LEGAL CONTRACT BETWEEN YOU AND TRANSIT & FLOW, LLC (“TRANSIT & FLOW,” “COMPANY,” “WE,” “OUR,” OR “US”). These Terms, together with any documents expressly incorporated by reference including our Privacy Policy, Warranty Terms, and Service Terms and Liability Agreement, govern your access to and use of https://transitflowplumbing.com, our mobile applications, our online booking system, our AI voice assistants, our SMS communications, and our residential and commercial plumbing, HVAC, and related home services (collectively, the “Services” and the “Platform”).

BY ACCESSING THE PLATFORM, REQUESTING SERVICES, OR OTHERWISE INTERACTING WITH TRANSIT & FLOW, YOU AGREE TO ALL TERMS CONTAINED HEREIN. IF YOU DO NOT AGREE, DO NOT ACCESS THE PLATFORM OR REQUEST OUR SERVICES.

THESE TERMS REQUIRE THE USE OF BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE MOST DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS, AND LIMIT THE REMEDIES AVAILABLE TO YOU IN THE EVENT OF A DISPUTE.

1. About Transit & Flow and Our Services

Transit & Flow, LLC is an Ohio limited liability company providing residential and commercial plumbing, HVAC, and related home service solutions across the Columbus, Ohio metropolitan area and surrounding markets. Transit & Flow is bonded and insured, and any work requiring state or local licensing is performed by properly licensed contractors where required by law.

Our Services include diagnostic visits, repairs, installations, replacements, maintenance plans, camera inspections, drain services, water heater services, gas line services, HVAC installation and service, and related home improvements. Details of specific service categories, pricing structures, and service areas are published on our Platform and updated from time to time.

2. Eligibility

Our Services are available to individuals eighteen (18) years of age or older who are legal owners of the property being serviced or who have full written or verbal authority from the legal owners to authorize services on the property. If you are booking on behalf of a business, property manager, or third party, you represent that you are authorized to bind that party to these Terms.

We reserve the right to refuse service, terminate access to the Platform, or decline any booking at our sole discretion, including where a booking address is outside our current service area, where a request violates applicable law, or where a customer has previously breached these Terms.

3. Booking, Estimates, and Diagnostic Visits

Bookings may be made through our website, mobile application, phone, SMS, third-party lead platforms, or through our AI voice assistant. All bookings are subject to availability and confirmation.

Our standard residential diagnostic visit fee is disclosed at the time of booking and is credited toward any work you approve and complete from that visit. After-hours urgent visits carry an additional after-hours fee, disclosed at booking and confirmed prior to dispatch. Commercial and multi-unit properties are subject to separate scope, pricing, and terms.

Estimates and quotes are provided in writing through our Platform, are valid for the timeframe stated on the quote, and are subject to acceptance through electronic signature or written approval. Work begins only after your acceptance. Discovery of concealed or pre-existing conditions after work begins requires a signed change order before additional work proceeds.

4. Payment Terms

Payment is due upon completion of services unless a written payment plan or approved third-party financing is in place. We accept credit card, debit card, ACH bank transfer, Zelle, and financing through approved partners. Zelle payments must be sent to pay@transitflowplumbing.com with the invoice number included in the memo field.

Balances unpaid thirty (30) days past the invoice due date may accrue a late charge of one and one-half percent (1.5%) per month, or the maximum rate permitted by Ohio law, whichever is less, together with reasonable collection costs.

Applicable sales and use taxes are calculated based on the service address and added to your invoice as required by Ohio law and local regulation.

You expressly agree not to initiate a chargeback with your credit card company without first contacting our billing team and providing a reasonable opportunity to resolve any dispute. In the event of an unauthorized chargeback, we reserve the right to report the unpaid balance to credit bureaus and pursue collection and lien remedies.

5. Third-Party Financing

Transit & Flow partners with third-party lenders, including Acorn Finance, to offer monthly payment options on qualifying invoices. Financing is offered as a convenience and is not required to receive our Services. All financing terms, rates, approvals, and payment schedules are determined solely by the lending partner based on your creditworthiness. Transit & Flow does not extend credit, guarantee approval, or set rates.

Checking your financing options through our partner is a soft credit inquiry and does not affect your credit score. Final approval and terms are subject to the lender’s underwriting.

6. Mechanic’s Lien Rights

Customer acknowledges and agrees that Transit & Flow, LLC, as a contractor providing labor, materials, equipment, and improvements to real property located in the State of Ohio, holds statutory lien rights under Ohio Revised Code Chapter 1311. In the event any invoice remains unpaid past the terms stated in this Agreement, Transit & Flow reserves the right, without waiver of any other remedy available at law or in equity, to take any or all of the following actions:

(a) Serve a Notice of Furnishing and record an Affidavit for Mechanic’s Lien against the improved property, in accordance with the procedures, timeframes, and notice requirements of Ohio Revised Code Chapter 1311.

(b) Recover from Customer all filing fees, recording fees, title search costs, service costs, reasonable attorney fees, and collection costs incurred in the preservation, filing, enforcement, foreclosure, or release of any lien, to the maximum extent permitted by Ohio law.

(c) Provide notice of the unpaid balance and any recorded lien to any known lender, mortgagee, title insurer, closing agent, escrow agent, or subsequent purchaser as permitted by law, which notice may affect the property’s title, refinance eligibility, or transferability until the balance is satisfied and the lien is released.

(d) Pursue any other collection remedy available under Ohio law, including referral to a collection agency, filing suit for the unpaid balance, and reporting the unpaid debt in accordance with applicable law.

Owner Authorization. Customer represents and warrants that Customer either owns the improved property or has full authority from all legal owners to approve the services performed by Transit & Flow and to subject the property to lien rights arising from this Agreement.

Late Payment and Escalation. Balances unpaid thirty (30) days past the invoice due date may accrue a late charge of one and one-half percent (1.5%) per month, or the maximum rate permitted by Ohio law. Transit & Flow may, in its sole discretion, initiate lien preservation procedures on balances that remain unpaid after forty-five (45) days and may record a Mechanic’s Lien and refer the matter for legal action on balances unpaid after sixty (60) days.

Discretion Reserved. Nothing in this Section creates an obligation on Transit & Flow to file, or to refrain from filing, a mechanic’s lien or to pursue any specific collection remedy.

Home Construction Service Suppliers Act. For residential contracts subject to the Ohio Home Construction Service Suppliers Act, Ohio Revised Code Chapter 4722, this Section is intended to satisfy applicable lien rights disclosure requirements.

7. Workmanship and Warranty

Transit & Flow warrants its workmanship for a period of one (1) year from the date of completion, subject to the terms and exclusions published at transitflowplumbing.com/warranty. Parts and equipment installed by Transit & Flow carry the applicable manufacturer warranty. Drain stoppage clearing is warranted for thirty (30) days against recurrence at the same point.

Warranty coverage does not extend to damage caused by pre-existing conditions, code deficiencies existing prior to service, customer-supplied parts, misuse, neglect, tampering by others, acts of God, or wear and tear inherent to aging systems.

8. Cancellations and Rescheduling

Cancellations and reschedule requests are welcome and can be made through the customer portal, by SMS, by phone, or by responding to any Transit & Flow communication. Cancellations made within two (2) hours of the scheduled arrival window may require dispatcher review to accommodate technician routing and may be subject to a dispatch fee at our discretion for repeat late cancellations.

We reserve the right to reschedule appointments due to emergencies, weather, staffing, or unforeseen operational circumstances, with prompt notice provided to you.

9. Photos, Recordings, and Documentation

Customer authorizes Transit & Flow technicians to take photographs, videos, and other visual documentation of the work area, equipment, findings, and completed work for quality assurance, warranty, training, and internal operational purposes. Marketing use of any customer-identifiable imagery requires separate opt-in consent.

Customer acknowledges that calls to and from Transit & Flow may be recorded or transcribed for quality assurance, dispatch, training, and legal purposes, and consents to such recording.

10. AI Voice Assistants and Automated Communications

Transit & Flow uses artificial intelligence-powered voice assistants, chat assistants, and automated communication systems to handle bookings, cancellations, appointment reminders, payment reminders, review requests, and other customer interactions. By interacting with Transit & Flow through our Platform, phone lines, or SMS, you consent to communicating with AI-powered systems. A human representative is available on request.

AI systems are provided as a tool to improve customer experience and operational efficiency and do not replace professional judgment on technical, licensing, or safety matters. Formal service commitments, quotes, and change orders require signed customer acceptance regardless of the communication channel used to originate them.

11. SMS and Text Messaging Terms

Transit & Flow may send you informational and transactional SMS and MMS messages related to our Services, including but not limited to appointment reminders, arrival notifications, quotes, estimates, invoices, payment reminders, review requests, and other business communications.

By providing your mobile phone number, you consent to receive recurring SMS and MMS messages from Transit & Flow. Message frequency varies based on your interactions with our Services. Message and data rates may apply.

Consent to receive text messages is not a condition of purchase or use of our Services.

To opt out of receiving text messages at any time, reply STOP to any message you receive from us. You will receive a one-time confirmation message, and no further messages will be sent unless you opt back in by replying START.

Carriers are not liable for delayed or undelivered messages. We reserve the right to modify or discontinue our text messaging services at any time, with or without notice, in accordance with applicable law.

12. Electronic Communications and Signatures

By using the Platform and our Services, you consent to receive electronic communications from Transit & Flow, including notices, disclosures, agreements, invoices, quotes, and other communications, and you consent to sign documents electronically under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Ohio Uniform Electronic Transactions Act.

Any notices, agreements, disclosures, or other communications sent electronically satisfy any legal writing requirement.

13. Website Accounts and Customer Portal

You may create a customer portal account to view your service history, invoices, quotes, and payment status. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at service@transitflowplumbing.com if you suspect unauthorized access to your account.

Information you provide must be accurate, complete, and current. You may update or correct your information by logging into your portal or contacting us directly.

14. Third-Party Sites, Lead Platforms, and Integrations

Our Platform may link to or integrate with third-party services, including Thumbtack, Google Business Profile, Angi, financing partners, payment processors, and others. These third parties operate under their own terms and privacy policies. Transit & Flow is not responsible for the practices, content, or performance of third-party services, and your use of any linked service is at your own risk and governed by that third party’s terms.

15. Prohibited Conduct

When using our Platform, Services, or communicating with our team, you agree not to harass, threaten, defame, or discriminate against Transit & Flow personnel, contractors, or other customers; provide false information about your identity, ownership of the property, or the scope of work required; use racially, ethnically, or otherwise offensive language toward our team; attempt to access, scrape, or extract data from our Platform through automated means; interfere with or disrupt the operation of our Platform or booking systems; post or transmit content that infringes intellectual property, privacy, or publicity rights of others; use our Platform to solicit or promote unrelated products or services; or engage in any conduct that we determine, in our reasonable discretion, is harmful to our business, reputation, or other customers.

Violation of these prohibitions may result in immediate termination of Services, account access, and referral to law enforcement or civil authorities as appropriate.

16. Intellectual Property

“Transit & Flow” and “Where Motion Meets Comfort” are trademarks of Transit & Flow, LLC. Our logos, website design, photography, technician training materials, service documentation, price lists, and marketing content are the property of Transit & Flow and may not be copied, reproduced, distributed, or used commercially without our express written consent.

All content, code, and materials on the Platform are protected by United States copyright and trademark law and by international treaties. Nothing in these Terms grants you any right or license in our intellectual property.

If you believe your intellectual property rights have been infringed on our Platform, contact service@transitflowplumbing.com with a detailed description of the alleged infringement and proof of your rights.

17. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN OUR SEPARATE WORKMANSHIP WARRANTY, THE PLATFORM AND ALL CONTENT, INFORMATION, MATERIALS, AND FEATURES PROVIDED THROUGH OR IN CONNECTION WITH THE PLATFORM ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” TRANSIT & FLOW MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE PLATFORM’S CONTENT AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS OR OMISSIONS.

TRANSIT & FLOW DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

This disclaimer does not affect any warranty rights that cannot be limited or excluded under applicable Ohio law, including the Ohio Consumer Sales Practices Act and the Home Construction Service Suppliers Act.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRANSIT & FLOW’S TOTAL LIABILITY ARISING FROM OR RELATING TO ANY SERVICE, USE OF THE PLATFORM, OR THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO TRANSIT & FLOW FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL TRANSIT & FLOW BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF USE, LOSS OF INCOME, LOSS OF DATA, LOSS OF BUSINESS, OR DIMINUTION IN PROPERTY VALUE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in this Section limits liability that cannot be limited under Ohio law, including liability for gross negligence, willful misconduct, fraud, or bodily injury caused by our negligence.

19. Indemnification

You agree to defend, indemnify, and hold harmless Transit & Flow, its officers, members, employees, contractors, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorney fees) arising out of or relating to your violation of these Terms, your misrepresentation of your ownership or authority over the serviced property, your unlawful or negligent use of the Platform or Services, or any third-party claim arising from information you provided to Transit & Flow.

20. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

Informal Resolution. Before initiating any formal proceeding, the parties agree to first attempt to resolve any dispute informally by contacting Transit & Flow at service@transitflowplumbing.com with a written description of the dispute. The parties will make a good faith effort to resolve the matter within thirty (30) days.

Binding Arbitration. If a dispute cannot be resolved informally, it shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be held in Franklin County, Ohio, or another mutually agreed location, and may be conducted by phone, video, or written submissions for claims under Ten Thousand Dollars ($10,000).

Waiver of Jury Trial and Class Actions. THE PARTIES WAIVE THEIR RIGHT TO A JURY TRIAL AND AGREE THAT DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY, NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

Exceptions. Notwithstanding the above, either party may bring an individual claim in small claims court, seek injunctive or equitable relief in court to protect intellectual property rights, and pursue mechanic’s lien enforcement under Ohio Revised Code Chapter 1311 in the appropriate Ohio court.

Governing Law. These Terms and any dispute arising from them shall be governed by the laws of the State of Ohio, without regard to conflict of law principles. Court proceedings permitted under this Section shall be brought exclusively in the state or federal courts located in Franklin County, Ohio, and the parties consent to personal jurisdiction and venue in those courts.

21. Force Majeure

Neither party shall be liable for failure or delay in performance (other than payment obligations) caused by events beyond that party’s reasonable control, including fire, flood, severe weather, pandemic, war, civil unrest, strikes, supply chain disruptions, cyberattacks, utility failures, or acts of government.

22. Termination and Suspension

We reserve the right to suspend or terminate your access to the Platform, the customer portal, or our Services at any time, with or without notice, for violation of these Terms, non-payment, abusive conduct, fraud, or any other reason we determine in our reasonable discretion. Provisions that by their nature should survive termination, including sections on payment obligations, lien rights, warranties, limitations of liability, indemnification, and dispute resolution, shall survive.

23. Changes to These Terms

Transit & Flow may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. The Effective Date at the top of this page indicates when these Terms were last updated. Continued use of the Platform or Services following the posting of updated Terms constitutes acceptance of the changes. For material changes, we will make reasonable efforts to notify you through the Platform, email, or SMS.

24. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, Warranty Terms, Service Terms and Liability Agreement, and any accepted quote or change order, constitute the entire agreement between you and Transit & Flow.

Severability. If any provision is held unenforceable, the remainder shall continue in full force.

No Waiver. Our failure to enforce any provision does not waive our right to enforce it later.

Assignment. You may not assign these Terms without our written consent. Transit & Flow may assign these Terms in connection with a merger, acquisition, sale of assets, or reorganization.

Headings. Section headings are for convenience only and do not affect interpretation.

No Third-Party Beneficiaries. These Terms are between you and Transit & Flow and create no rights in third parties, except as expressly stated for lienholders, subcontractors, and financing partners where applicable.
